Michigan Senate Votes 37-0 to Defeat NDAA
In a vote of 37-0 (1 absent), the Michigan Senate joined the growing list of of states and municipalities throughout America in passing their version of the Liberty Preservation Act, released by the Tenth Amendment Center. Senate Bill 94 (SB94) now proceeds to the Michigan State House. State Senator Rick Jones, the bill's sponsor, and grassroots activists forged the bipartisan alliance against the federal law which applies the law of war and indefinite detention to anyone on U.S. soil.
After the bill's passage in the Senate, PANDA Michigan's Dennis Marburger vowed relentless opposition to all federal legislation which subverts the U.S. Constitution, saying:
“The very active and knowledgeable group of Michiganians fighting this egregious Federal overreach will not rest until there is real, tangible and viable state resistance to D.C.'s attempts to deny our rights and threaten our safety – whatever unconstitutional legislation, edict or judicial fiat our government employees use as an excuse.”
The unlawful mandates of the NDAA are sections 1021 and 1022 which allow the arrest, detention and/or transport to foreign prisons of anyone the federal government “suspects” is a terrorist. Those so imprisoned can be denied trial, access to an attorney, and the ability to even advise seomone they have been detained.
To enforce NDAA, the federal government will need assistance from the states. If signed into law, SB94 will announce the strong determination of the people of Michigan that the 2012 NDAA is unConstitutional.
SB94 is a companion bill of HB4138, sponsored by State Representative Tom McMillin. A similar bill passed the Michigan House last fall on a vote of 107-0.
If you are in Michigan, or know someone in Michigan, it is time to fight for your rights.

It is inappropriate for an administration to sign law which denies the rights all citizens of the United States are granted. The current administration has gone on record saying we won't fully act out the extent of this law. That line of reasoning is a huge concern that an administration would find it OK to establish heavy restrictions on the citizens which may easily be imposed by future administrations or persons within the current administration whom act without restraint.
The restrictions passed and admission to them is like saying "I'm only a little bit pregnant."
"Inappropiate" is gross understatement! It is T R E A S O N…Good on Michigan for RESISTING the 'new' tyranny! We have a new King Geo. III, and he MUST be STOPPED!!!
As a Michigan resident, I could not be more proud of all members of the Michigan State Senate right now! I applaud all efforts to retain and maintain our hard won Constitutional rights. BRAVO Senators, and I pray that the State House follows suit.
Makes me happy to be moving back to my home state in April 🙂
The NDAA was actually authored by US Senator Carl Levin, from Michigan. One would think there would be an effort to unseat him.
Yes, it was, and THAT S.o.B. TRAITOR has authored MANY pieces of TREASON vs. the American people. I know a lamppost with HIS name on it…
This is laughably ironic since Governer "Herr" Snyder has put into effect draconian Emergency Manager laws that can strip any community in Michigan of its elected officials, financial control and almost everything else locals voted for. It's the battle of the caliphs in this country now.
Hi all, I wish we had more of these type of PATRIOTS that you have in Michigan, we have DEMS in control of both houses and a bill like this will NEVER EVER GET A HEARING let alone voted on. I believe most if not ALL of us in Co know the NDAA IS UNCONSTITUTIONAL and must be REPEALED but know it will never happen. Our govt should be going after their own, they are the REAL TERRORIST not the American patriots. Thanks, Ed Warden
Great leadership here; thanks for serving the cause of us all – liberty.
Even Alexander Hamilton, who could not see the danger a central bank would impose, could see the legal lines of nullification very clearly; the very Declaration was an act of nullification of fiat power in favor of authority pursuant to non-positive "natural" Law. Hamilton explained it thus, in The Federalist, No. 33:
"If a number of political societies enter into a larger political society, the laws which the latter may enact, pursuant to the powers intrusted to it by its constitution, must necessarily be supreme over those societies and the individuals of whom they are composed…. But it will not follow from this doctrine that acts of the larger society which are not pursuant to its constitutional powers, but which are invasions of the residuary authorities of the smaller societies, will become the supreme law of the land. These will be merely acts of usurpation, and will deserve to be treated as such." (Emphasis in original.)
And if the person arrested is a white American the Michigan Militia will fight to the death. But if the person arrested is American but looks like an Arab I wonder how vigilent the reaction would be. Hope I am wrong…
