The City Council of League City, Texas voted 7-1 to reject NDAA's unconstitutional mandates. As the bill states, the NDAA authorizes:

“1) detainment of persons captured within the United States of America without charge or trial, 2) military tribunals for persons captured within the United States of America, and 3) the transfer of persons captured within the United States of America to foreign jurisdictions, are repugnant to the ‘general, great and essential principles of liberty and free government’ enshrined in Article 1 of the Texas Constitution.”

The resolution instructs League City's public agencies to refuse compliance with NDAA action against anyone. As former New Jersey Superior Court Judge Andrew Napolitano said recently, widespread noncompliance can make a federal law “nearly impossible to enforce”.

Council Member Heidi Theiss sponsored the League City bill and afterward offered thanks to her fellow Council members. Moreover, Theiss said in her Facebook victory announcement:

“there is strong legislation in our state capital that needs to pass [in order] to refuse the use and abuse of federal power against American citizens.” She refers to HB 149, which just had a hearing in a committee of the Texas State House. It will need passing votes in two committees before moving to the full House.

Proponent after proponent of the NDAA has said "indefinite detention" could never happen here. They could not be more wrong. 

In a chilling letter sent to Carlos Warner, a Federal Public Defender, Guantanamo Bay prisoner Faiz al-Kandari said:

"“I scare myself when I look in the mirror. Let them kill us as we have nothing to lose. We died when Obama indefinitely detained us.  Respect us or kill us. It is your choice. The US must take off its mask and kill us.”

There is nothing more to say. This is why we fight.

After being thrown under the bus by the Washoe County, NV Commission, who last meeting attempted to sneak a useless resolution through, PANDA Nevada showed up in force to demand the Commission actually take action.

One after another, citizens demanded the Commission defend their god-given, unalienable rights. Little by little, the 2012 NDAA is sneaking into the mainstream media. Battle after battle is being waged across the country to combat this ridiculous law. 

Two weeks ago, in Lenawee County, MI, the County Commission deadlocked 4-4 on passing anti-NDAA legislation. Although 4 commissioners, including Commissioner Cletus Smith, voted in favor of liberty, several others demonstrated complete ignorance of the issue at hand.
 

What were some of the assumptions made by these Commissioners, who voted against the rights of the people?
 

Commissioner Chris Wittenbach:

“It’s not going to have much impact one way or another,”

Although this legislation won't jump off the page and stand between a military officer and a suspect, it does provide a deterrent to enforcing the NDAA and its detention power in Lenawee County. Much like the Bill of Rights does not keep our rights from being violated, but it does provide a deterrent, and a foundation to preserve them.

Commissioner David Stimpson:

“I absolutely don’t want to comment on this. It’s absolutely ridiculous for us to discuss this”

He's right. It is entirely ridiculous for anyone to be discussing the indefinite military imprisonment, execution, or torture of anyone without charge or trial in America. It's like a bad dream to be talking about America like she's turning into Stalin's Russia…yet we are. 

Ridiculous situations call for appropriate responses. It's ridiculous for us to be talking about this, but since we have been forced to, we must respond to protect the rights of the people. 

Stimpson again:

"Stimpson said federal courts have already upheld the constitutionality of the National Defense Authorization Act. Voting to oppose the law would violate commissioners’ oaths to uphold the law, he said."

Firstly, although Federal Courts have upheld the Constitutionality of previous NDAA's, the 2012 NDAA has been declared unConstitutional by the 4th District Court and Judge Katherine B. Forrest. 

Secondly, the Commissioner's oath is not to uphold the law. It is to uphold the Constitution. The Michigan Oath of Office reads as follows:

“I don’t want to support anything that’s opposed to a constitutional rule”

The 2012 NDAA allows any person, including American citizens, to be indefinitely detained without charge or trial, sent to a foreign country to be held, and even executed. Not a single law has eradicated more of our Constitution protections since the Civil War. 

Now, Arizona has a chance to defeat it. Arizona has the chance to become the first state in America to enact real protections for its citizens against the NDAA. HB 2573, introduced by Rep. Carl Seel, passed Committee 6-2 last month, and passed the Rules Committee yesterday. 

Yet, one Representative does not see the tide turning to liberty. Representative Andy Tobin is currently blocking HB 2573 from receiving a full House vote. He is willing to kill protection for the people of Arizona, and allow the Federal government to trample the rights of his constituents.

We will not allow him to block this bill. The rights of the people of Arizona depend on it.

Show Rep. Tobin the tide is turning in favor of liberty. Urge him, politely but firmly, to bring HB 2573 up for a vote. 

If you have to leave a message, ask him to call you back. If you send an email, ask for his reply and tell him to honor his Oath. Forward this crucial message on to friends and family.
